Don Lemon’s latest headline isn’t coming from a newsroom—it’s coming from a federal courtroom. And, fittingly for one of America’s most outspoken journalists, the legal drama surrounding his indictment is getting louder.
The former CNN anchor was indicted in Minnesota over his involvement in a January protest at Cities Church in St. Paul. Federal prosecutors accuse Lemon and others of conspiring to interfere with worshippers’ constitutional rights and violating a provision of the Freedom of Access to Clinic Entrances Act, or FACE Act. Lemon has pleaded not guilty and maintains that he was there as a journalist covering the demonstration, not participating in it.
Now, the case has developed a plot twist worthy of cable news. A federal judge has demanded extensive grand jury materials, including prosecutors’ presentations, legal instructions, witness testimony and communications with jurors. Lemon’s attorneys have argued that there were irregularities in the grand jury process and are seeking dismissal of the case.
Lemon’s lawyers have also accused the government of vindictive prosecution, pointing to President Donald Trump’s long history of publicly criticizing the journalist. They argue the prosecution is tied to Lemon’s political commentary rather than his conduct at the church.
Adding another layer, Lemon’s defense is challenging the constitutionality of the FACE Act as applied to the case and arguing that his First Amendment rights protect his work as a journalist.
For now, the Don Lemon indictment remains far from settled. What began as a protest and a livestream has turned into a major legal fight over journalism, free speech and the limits of federal power.
